This test product is licensed for private assessment only and any distribution, exploitation, commercial use or other non-private use is breach of the licence which could result in legal action.

The Equavescent product includes technology or features disclosed in the following patent portfolio owned by Lachlan Barratt

We grant you a non-exclusive, non-transferable, royalty-free, single user licence to use the product, subject to the following conditions on this and the following pages

You must use the product only for the purpose described on our website.

The product is for your use only on a single computer or device and this licence cannot be transferred or sublicensed.

You must not copy, reproduce, decompile, reverse engineer, distribute, publish, re-sell or commercially exploit the product. Reverse engineering includes cloning approximations of fft frequency responses using this product for use in other products.

We own or control all right, title and interest in the intellectual property in the product (including copyright, patents and trade marks) and you must not infringe those intellectual property rights.

If you purchase a product, a licence file will be emailed to your nominated email address once payment has been made, in order for you to activate this licence.

To the extent permitted by law, in the event of any product failure, error or defect your rights are limited to re-supply of a licence file or a refund of your payment, at our option, and all other liability in connection with this agreement or the product, whether in contract, tort (including negligence), statute or otherwise, is excluded.

To the extent permitted by law, we exclude all warranties in connection with the product. A demonstration download of the product is available so that you can determine whether the product is suitable for you and compatible with your computer or device.

While we keep records of any purchase, we can also ask you to provide reasonable evidence of purchase of this licence, if you make a claim under this agreement. You must therefore retain these records.

You must not assign this agreement.

If this agreement or any part of it is held to be void or unenforceable, the balance of the agreement remains enforceable according to its terms.

Your purchase is governed by the law of New South Wales, Australia, and any disputes must be resolved in the courts of that jurisdiction.

We do not guarantee that the product complies with the laws of the country in which you purchase it. You are responsible for complying with the local laws of that country.

This is the entire agreement governing your use of a product and it may be amended only by further written agreement between us. This licence applies both to demonstration downloads and any purchase of the product. In the case of demonstration downloads, you agree to these terms in consideration for a licence of our demonstration download.
